Terms of Service

These Terms of Service ("Terms") govern your use of SmartRating ("Service"), operated by Web Ninja Solutions ("Company", "we", "us", or "our") at smartrating.io. By accessing or using the Service, you agree to be bound by these Terms.

1. Use of the Service

SmartRating provides AI-powered tools to help businesses collect and manage Google reviews. You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service to generate fake, misleading, or fraudulent reviews
  • Attempt to manipulate Google's review systems in violation of Google's policies
  • Reverse engineer, decompile, or extract the source code of the Service
  • Use the Service in any way that could damage, disable, or impair it
  • Use automated tools to access the Service without prior written consent
  • Resell or sublicense access to the Service without prior written consent

2. Accounts

You must create an account to use most features of the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account at support@smartrating.io.

You must be at least 18 years old to create an account. By creating an account, you represent that you meet this requirement.

3. Subscriptions and Billing

Paid plans are billed on a recurring monthly basis. By subscribing, you authorise us to charge your payment method at the start of each billing period.

  • Upgrades take effect immediately and are prorated.
  • Downgrades take effect at the end of the current billing period.
  • Cancellations take effect at the end of the current billing period; you retain access until then.
  • Failed payments may result in suspension of your account. We will notify you by email and retry the charge.

All fees are exclusive of applicable taxes. We reserve the right to change pricing with 30 days' notice.

4. Refund Policy

Refunds are handled in accordance with our Refund Policy. Generally, we offer a 7-day refund window for new subscriptions if you are not satisfied with the Service.

5. AI-Generated Content

The Service uses artificial intelligence to generate suggested review drafts. These drafts are provided as a starting point for your customers. You acknowledge that:

  • AI-generated content may not always be accurate or appropriate
  • You are solely responsible for ensuring any review posted complies with Google's review policies
  • We do not guarantee that AI-generated reviews will improve your business ratings or rankings
  • You must not use the Service to post reviews that are false or that you know to be misleading

6. Intellectual Property

The Service, including all content, features, and functionality, is owned by the Company and is protected by copyright, trademark, and other intellectual property laws. You retain ownership of any business data or content you upload to the Service.

By uploading content (such as logos), you grant us a non-exclusive, royalty-free licence to use, store, and display it solely for the purpose of providing the Service to you.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Third-Party Services

The Service integrates with third-party services including Google, Stripe, and Supabase. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the practices of any third-party service.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not guarantee any specific results from using the Service, including increased review counts or improved search rankings.

10. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your account at any time if you violate these Terms or if we reasonably believe your use of the Service is harmful. Upon termination, your right to use the Service ceases immediately. You may export your data for 30 days following termination by contacting us.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice in the Service at least 14 days before changes take effect. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of India.
